Privacy Policy

1. Data Controller. InfinityProcessLabs, with registered office at Pssg. del Port 13, Porto Petro, Santanyi, Illes Balears, Espana, is the data controller responsible for the processing of personal data collected through this website.

2. Data We Collect. When you submit a contact form or interact with our services, we may collect: your full name, email address, phone number, company name, IP address, browser type, and any information voluntarily provided in form fields. We do not collect special category data (health, biometric, political, religious) unless explicitly required and consented.

3. Legal Basis for Processing. We process your personal data under the following legal bases as defined in Article 6 of the EU General Data Protection Regulation (GDPR): (a) consent — when you voluntarily submit forms; (b) contractual necessity — when processing is required to fulfil a service agreement; (c) legitimate interest — for improving our services, security monitoring, and fraud prevention.

4. Purpose of Processing. Your data is processed for: responding to inquiries, delivering contracted services, sending service-related communications, maintaining internal analytics, complying with legal obligations, and improving website functionality.

5. Data Retention. Personal data is retained only for as long as necessary to fulfil the purposes for which it was collected. Contact form submissions are retained for a maximum of 24 months. Contract-related data is retained for the duration of the contract plus 6 years to comply with tax and accounting obligations.

6. Data Sharing. We do not sell or rent personal data to third parties. Data may be shared with: hosting providers (for infrastructure), payment processors (for transactions), analytics tools (for service improvement), and law enforcement (when legally required). All third-party processors are bound by Data Processing Agreements (DPAs) in compliance with GDPR Article 28.

7. International Transfers. If data is transferred outside the European Economic Area (EEA), we ensure adequate protection through Standard Contractual Clauses (SCCs) or adequacy decisions as per GDPR Chapter V.

8. Your Rights. Under the GDPR, you have the right to: access your data (Art. 15), rectify inaccurate data (Art. 16), erase your data (Art. 17), restrict processing (Art. 18), data portability (Art. 20), object to processing (Art. 21), and withdraw consent at any time (Art. 7). 9. Automated Decision-Making. InfinityProcessLabs does not engage in automated decision-making or profiling that produces legal effects concerning you.

10. Supervisory Authority. You have the right to lodge a complaint with the Agencia Espanola de Proteccion de Datos (AEPD) if you believe your data protection rights have been infringed.

Cookies Policy

1. What Are Cookies. Cookies are small text files placed on your device when you visit a website. They serve to remember preferences, maintain sessions, and analyse site traffic.

2. Cookies We Use. InfinityProcessLabs uses the following categories of cookies: (a) Strictly Necessary Cookies — required for core site functionality (e.g., cookie consent state stored in localStorage). These cannot be disabled. (b) Functional Cookies — remember your preferences and settings to enhance your experience. (c) Analytics Cookies — help us understand how visitors interact with our site, enabling us to optimise performance and content.

3. Third-Party Cookies. We may use third-party services (e.g., Google Analytics) that set their own cookies. These providers have their own privacy policies governing data collection. We do not allow advertising or tracking cookies without explicit consent.

4. Managing Cookies. You can control and manage cookies through your browser settings. Most browsers allow you to refuse or delete cookies. Disabling strictly necessary cookies may impair site functionality. Our cookie consent banner allows you to accept or decline non-essential cookies at any time.

5. Cookie Retention. Session cookies are deleted when you close your browser. Persistent cookies remain for a period specified in the cookie table or until manually deleted. The cookie consent state is stored in localStorage with no expiration.

6. Consent. In compliance with the ePrivacy Directive (2002/58/EC) and GDPR, non-essential cookies are only activated after you provide explicit consent via our cookie banner. You may withdraw consent at any time by clearing your browser storage.

Refund Policy

1. General Policy. InfinityProcessLabs is committed to delivering high-quality SaaS engineering services. Due to the custom, project-based nature of our work, refunds are evaluated on a case-by-case basis in accordance with project milestones and deliverables.

2. Pre-Development Cancellation. If you cancel a project before any development work has commenced, you are entitled to a full refund of any advance payment within 14 business days, minus any non-recoverable administrative fees (not exceeding 5% of the total payment).

3. Mid-Project Cancellation. If cancellation occurs after development has begun, refunds are calculated proportionally based on completed milestones as documented in the project scope agreement. Work already delivered and approved is non-refundable.

4. Defective Deliverables. If a delivered milestone fails to meet the agreed-upon specifications documented in the project scope, InfinityProcessLabs will rectify the defect within 30 days at no additional cost. If rectification is not feasible, a partial or full refund for that milestone will be issued.

5. Refund Request Process. To request a refund, contact [email protected] with your project reference, description of the issue, and supporting documentation. Refund requests are reviewed within 10 business days. Approved refunds are processed via the original payment method within 14 business days.

6. Non-Refundable Items. Consultation fees for work already rendered, domain registration fees, third-party license costs, and infrastructure setup fees incurred on your behalf are non-refundable.

7. EU Consumer Rights. If you are a consumer within the European Union, you may have additional statutory withdrawal rights under the Consumer Rights Directive (2011/83/EU). These rights do not apply to services that have been fully performed with your prior consent.

Terms of Service

1. Acceptance of Terms. By accessing or using the services of InfinityProcessLabs, located at Pssg. del Port 13, Porto Petro, Santanyi, Illes Balears, Espana, you agree to be bound by these Terms of Service. If you do not agree, you must not use our services.

2. Services. InfinityProcessLabs provides custom SaaS engineering, cloud infrastructure, user flow optimization, and related technical services. Service scope, deliverables, timelines, and pricing are defined in individual project agreements or statements of work (SOWs) agreed upon before project commencement.

3. Intellectual Property. Upon full payment, all custom code, designs, and deliverables created specifically for you under a project agreement are transferred to your ownership. InfinityProcessLabs retains ownership of pre-existing tools, libraries, frameworks, and methodologies used in the delivery process. These are licensed to you for use within the scope of the delivered project.

4. Confidentiality. Both parties agree to maintain the confidentiality of proprietary information exchanged during the course of engagement. This obligation survives termination of the agreement for a period of 3 years.

5. Payment Terms. Invoices are payable within 14 days of issuance unless otherwise agreed. Late payments incur a statutory interest rate of 8% per annum plus applicable recovery costs as per EU Directive 2011/7/EU on late payments. InfinityProcessLabs reserves the right to suspend work on outstanding invoices.

6. Limitation of Liability. InfinityProcessLabs' total liability shall not exceed the total fees paid under the relevant project agreement. We shall not be liable for indirect, consequential, or incidental damages including lost profits, data loss, or business interruption.

7. Warranty. Deliverables are warranted to function as documented in the project scope for a period of 60 days following delivery. This warranty does not cover issues arising from third-party services, unauthorized modifications, or misuse.

8. Termination. Either party may terminate a project agreement with 14 days' written notice. Upon termination, you are obligated to pay for all work completed up to the termination date. Sections on Confidentiality, Intellectual Property, and Limitation of Liability survive termination.

9. Governing Law. These Terms are governed by the laws of the Kingdom of Spain and the European Union. Any disputes shall be resolved in the courts of Palma de Mallorca, Illes Balears, Spain.

10. Amendments. InfinityProcessLabs reserves the right to update these Terms. Material changes will be communicated via email to active clients at least 30 days before taking effect. Continued use of services after the effective date constitutes acceptance.
